Terms of Service

1. Acceptance of Terms

By registering for an account, starting a trial, or using the Service in any way, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), have read and understood these Terms, and agree to be legally bound by them.

2. Description of Service

Tubify provides AI-powered thumbnail generation, SEO tools, face training, channel analytics, and related features for YouTube creators, agencies, and content networks. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, and we shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

3. Account Registration and Security

You must provide accurate, current, and complete information when creating an account. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at support@tubify.co of any unauthorized access to or use of your account.

4. Subscription, Billing, Trials, and Cancellation

• Paid Trials: Certain subscription tiers offer a paid 3-day trial. Your payment method will be charged the applicable trial fee (GROW: $1; LEGACY: $9; STUDIO: $19) at the start of the trial period.
• Auto-Renewal: Unless you cancel before the end of your trial or current billing period, your subscription will automatically renew at the regular monthly rate for your selected plan (SPARK: $9/mo; GROW: $19/mo; LEGACY: $39/mo; STUDIO: $79/mo).
• Cancellation: You may cancel your subscription at any time through your account settings or by contacting support@tubify.co. Cancellation takes effect at the end of the current billing cycle. You will retain access to the Service until that date.
• No Refunds: Except where required by applicable law, all fees are non-refundable. We do not provide refunds or credits for partial months or unused features.
• Pricing Changes: We reserve the right to change our pricing at any time. We will provide at least 30 days' notice of any price changes before they take effect. Continued use of the Service after the effective date of a price change constitutes your acceptance of the new pricing.
• EU/UK Consumer Rights: If you are a consumer located in the EU or UK, you may have a statutory right to cancel a subscription within 14 days of purchase (the "cooling-off period"). By accessing the Service immediately after purchase, you acknowledge that you consent to the Service beginning before the cooling-off period expires, and you understand that your right of withdrawal may be limited once the Service has been fully performed.

5. User Content and Intellectual Property

• Your Content: You retain all ownership rights to the images, text, and other materials you upload or generate using the Service ("User Content"). By using the Service, you grant Tubify a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, process, and display your User Content solely for the purpose of providing and improving the Service.
• Tubify's Property: The Service — including its software, algorithms, design, branding, and trademarks — is the exclusive property of Tubify and its licensors. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent.
• Feedback: Any feedback, suggestions, or ideas you provide to us regarding the Service may be used by Tubify without any obligation to you.

6. Acceptable Use Policy

You agree not to use the Service to:

• Generate, upload, or distribute content that is illegal, harmful, defamatory, obscene, or infringes on any third party's intellectual property rights.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the Service.
• Interfere with or disrupt the integrity, security, or performance of the Service or its infrastructure.
• Use automated tools, bots, or scrapers to access the Service without our express written permission.
• Violate any applicable local, national, or international law or regulation.

We reserve the right to suspend or terminate your account immediately if you violate this Acceptable Use Policy.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Tubify and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business opportunities — arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to Tubify in the 12 months preceding the claim.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Indemnification

You agree to indemnify, defend, and hold harmless Tubify and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

For users located in the EU or UK: Nothing in these Terms affects your rights as a consumer under applicable EU or UK consumer protection law, including your right to bring a claim before the courts of your country of residence.

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the revised Terms on this page and updating the "Last Updated" date. Continued use of the Service after any changes constitutes your acceptance of the updated Terms.
